What to do after an accident in Texas
After an accident, your health comes first, and every situation is different. These are general steps that often help protect your health and the information in your case; if you cannot do them right away, some can sometimes be done later, depending on the case.
- Get medical care soon and follow your doctor's instructions.
- If you can, take photos of the scene, the vehicles and your injuries.
- Write down the name, phone, plate number and insurance of the others involved and of any witnesses.
- Ask for the police report number; depending on where the crash happened, it may come from the San Antonio Police Department (SAPD), the Bexar County Sheriff's Office or the Texas Department of Public Safety (DPS), and crash reports can generally be requested through TxDOT.
- Keep medical records, receipts and any paperwork related to the accident.
- Think before posting on social media or signing documents from an insurance company.

Texas deadlines and rules worth knowing
Many Texas personal-injury claims generally have a two-year deadline from the date of the injury (Texas Civil Practice and Remedies Code section 16.003). There are exceptions: for example, claims against the City of San Antonio, Bexar County, a public transit authority or another government body can require written notice within a matter of months, or less if a city charter or local ordinance sets it, and the deadline can change if the injured person is a minor. Every case is different.
Texas also has rules about shared fault. In general terms, if it is determined that you were partly at fault, your compensation can be reduced by that percentage, and you may recover nothing if your share is greater than half. That is why the facts need to be reviewed carefully.
After a car crash, the responsible driver's insurance is often reviewed, and so is your own policy, for example medical coverage (PIP or MedPay) and coverage for uninsured or underinsured drivers. What applies depends on the policy and on the case.
If you now live in Mexico
A person can be hurt in Texas while working, visiting family or traveling, and then return to Mexico. Often, an accident that happened in Texas is handled under Texas law, although this can depend on the facts and the parties involved, and living in another country generally does not pause the deadline to file a claim.
If a lawsuit is filed, it is often filed in the county where the accident happened, which for a crash in San Antonio is usually Bexar County; the exact rules depend on the case. Distance can complicate some steps, such as getting medical records, translating them if they were issued in Mexico, or arranging a medical appointment or a statement. If you received care in Mexico, keep those records and receipts. Much of the communication can happen by phone or WhatsApp, whichever is more practical for you. How workable each step is depends on the case.
How it starts: who answers first
When you call or write, a virtual assistant answers first: Diego by phone and Lola on WhatsApp. Neither of them is a lawyer.
To make the first conversation more useful, you can have the following at hand, although you do not need to have everything:
- The date and place of the accident, such as the street, intersection or highway
- A short description of what happened and of your injuries
- The names of the insurance companies and the report number, if you have them
- Photos, medical records and receipts, if you have them
- A phone or WhatsApp number where you can be reached, and the language you prefer
